These Terms of Service ("Terms") govern your access to and use of the services provided by Monolithik LLC ("Monolithik," "we," "us"). By accessing or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.

Service Description

Monolithik provides software that assists healthcare professionals with clinical documentation. The service is a documentation tool only. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for the professional judgment of a licensed clinician.

Acceptable Use

You agree not to:

• Use the service in violation of any applicable law or regulation.
• Upload content you do not have the right to process, or use the service without a required Business Associate Agreement in place.
• Attempt to gain unauthorized access to, probe, or disrupt the service or its infrastructure.
• Reverse engineer, resell, or sublicense the service except as expressly permitted.

No Guarantee of Insurance Approval

Monolithik does not guarantee that documentation produced with the service will be accepted, reimbursed, or approved by any insurer, payer, or other third party. Coverage, reimbursement, and audit outcomes depend on factors outside our control, and you remain solely responsible for the accuracy and completeness of your records.

Limitation of Liability

The service is a tool to support your documentation. You, as a licensed professional, retain full and exclusive responsibility for all clinical decisions, the content of your records, and the care you provide. Monolithik does not practice medicine and assumes no clinical responsibility.

To the maximum extent permitted by law, Monolithik and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any claim of professional malpractice, arising out of or relating to your use of the service. The service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Our total aggregate liability for any claim relating to the service shall not exceed the amounts you paid to Monolithik in the twelve months preceding the claim.

Termination

You may stop using the service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the security and integrity of the service. Upon termination, your right to use the service ceases, and we will handle your data in accordance with our Privacy Policy.

Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Utah.
